Photo Upload Disclaimer and Consent Agreement

1. Parental or Guardian Consent

• If the photo you are uploading features a minor (under 18 years old), you confirm that you are the parent or legal guardian of the child and have given explicit consent to upload the photo and share it for the purposes described below.
• By uploading the photo, you acknowledge that you have obtained all necessary permissions to do so in accordance with Canadian privacy laws.

2. Consent for Use and Collection of Personal Information

• You understand that the uploaded image and any accompanying personal information (e.g., player’s name, team name) are collected, used, and disclosed in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.
• By uploading the photo, you grant Quikcard the right to use the image for the purposes outlined below.

3. Purpose of Use

• Uploaded photos will be used for:
  • Display in the public Player of the Game gallery on this website.
  • Promotion of Minor Hockey Week through newsletters, social media channels, and other digital platforms managed by Quikcard.
  • Marketing or promotional materials related to future events.
• Quikcard will not use the photo for any other purposes without obtaining further consent.

4. Storage and Retention of Personal Information

• Uploaded photos and personal data will be stored securely and retained only for as long as necessary to fulfill the above purposes.
• You may request the removal of your photo at any time, and it will be deleted within 10 business days of receiving the request.

5. Privacy Protection and Third-Party Access

• Quikcard will protect uploaded images and personal data in accordance with PIPEDA and other applicable privacy laws.
• While the gallery is publicly accessible, Quikcard is not responsible for unauthorized use or sharing of the images by third parties who access the gallery or promotional content.

6. Right to Withdraw Consent

• As a parent or legal guardian, you may withdraw your consent at any time by contacting 1.800.232.1997.
• Upon receipt of your request, the image and related data will be removed from the gallery and all promotional materials within 10 business days.

7. Content Guidelines and Right to Remove

• You agree that the uploaded photo will not contain any offensive, inappropriate, or unlawful content.
• Quikcard reserves the right to remove any photo that does not adhere to these guidelines.

8. Liability and Indemnification

• By uploading a photo, you release and hold harmless Quikcard from any claims, liabilities, or damages arising from the use or display of the image as described above.
• You further agree to indemnify Quikcard against any legal claims related to the use of the uploaded content, especially in cases where proper consent was not obtained.
